These Terms of Service ("Terms") govern your access to and use of connectorjpa.com (the "Site"), operated by the Capital SouthEast Connector Joint Powers Authority ("Connector JPA," "we," "us," or "our"), a public agency formed under California's Joint Exercise of Powers Act. Please read these Terms carefully before using the Site.
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, please do not use the Site.
About the Site
The Site provides information about the Capital SouthEast Connector project, including project segments, board meetings, public notices, news, and ways to contact us and stay informed. The Site is provided as a public service for general informational purposes.
Use of the Site
You may use the Site for lawful purposes and in accordance with these Terms. When using the Site, you agree that you will not:
- Use the Site in any way that violates any applicable federal, state, or local law or regulation
- Attempt to gain unauthorized access to, interfere with, damage, or disrupt the Site, its servers, or any connected systems or networks
- Introduce any viruses, malware, or other harmful code to the Site
- Use any robot, scraper, or other automated means to access the Site in a manner that places an unreasonable load on our infrastructure, except for legitimate search engine indexing
- Attempt to probe, scan, or test the vulnerability of the Site or breach any security or authentication measures
- Impersonate or attempt to impersonate the Connector JPA, a Connector JPA official or employee, another user, or any other person or entity
- Use the Site to transmit unlawful, harassing, defamatory, abusive, threatening, or otherwise objectionable material
- Use the Site in any manner that could disable, overburden, damage, or impair it, or interfere with any other party's use of the Site
We reserve the right to restrict or terminate access to the Site, in whole or in part, to anyone who violates these Terms or for any other reason, to the extent permitted by law.
Public Records and User Submissions
The Connector JPA is a public agency subject to the California Public Records Act and related open-government laws. If you submit a comment, question, contact form, or other communication through the Site, that submission — including your name, contact information, and the contents of your message — may constitute a public record and may be subject to disclosure to members of the public upon request. Please do not submit confidential, sensitive, or proprietary information that you would not want disclosed.
By submitting content to us through the Site (such as comments or messages), you grant the Connector JPA the right to use, reproduce, store, display, and distribute that content as necessary to operate the Site, respond to you, carry out our public functions, and comply with our legal obligations, including records retention and public records requirements. You represent that you have the right to submit the content and that it does not infringe the rights of any third party.
Intellectual Property
The content on the Site — including text, graphics, logos, icons, images, maps, documents, and the design and arrangement of the Site — is owned by or licensed to the Connector JPA, unless otherwise noted, and may be protected by copyright, trademark, and other laws.
As a public agency, many of our records are available to the public under the California Public Records Act. However, the availability of a record under public records law does not, by itself, grant you ownership of that record or unrestricted rights to reproduce, distribute, or reuse it for commercial purposes. You may view, download, and print materials from the Site for personal, non-commercial, educational, or governmental informational purposes, provided you do not remove or alter any copyright or other proprietary notices.
The "Capital SouthEast Connector" and "Connector JPA" names, logos, and related marks may not be used without our prior written permission, including in any manner that suggests our endorsement, sponsorship, or affiliation.
Accuracy of Information; No Professional Advice
The Connector JPA strives to keep the information on the Site accurate and current. However, the Site relates to an ongoing public infrastructure project, and project information — including plans, alignments, maps, schedules, designs, and other details — is subject to change and may be preliminary, conceptual, or updated without notice.
Information on the Site is provided for general informational purposes only and is not intended as, and should not be relied upon as, legal, engineering, financial, or other professional advice. The Site does not create any contractual rights, entitlements, or obligations, and you should not rely on the Site as the sole basis for any decision. Limitation of Liability
To the fullest extent permitted by law, the Connector JPA and its board members, officials, officers, employees, agents, and consultants will not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or related to your access to or use of, or inability to access or use, the Site or any content on it, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits, waives, or modifies any rights, defenses, or immunities of the Connector JPA as a public entity under applicable law, including the California Government Claims Act and other laws governing the liability and immunities of public entities and public employees.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Connector JPA and its board members, officials, officers, employees, agents, and consultants from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your misuse of the Site, your violation of these Terms, or your violation of any rights of a third party.

Any legal action or proceeding relating to the Site or these Terms shall be brought exclusively in the state or federal courts located in Sacramento County, California, and you consent to the jurisdiction of those courts.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
